A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO THE MISSISSIPPI CONSTITUTION OF 1890, BY CREATING A NEW SECTION 208A, TO PROHIBIT ANY STATE AGENCY, INSTITUTION OR INSTRUMENTALITY OF THE STATE, OR THE GOVERNING AUTHORITIES OF A COUNTY, MUNICIPALITY OR SCHOOL DISTRICT, FROM ENACTING OR ENFORCING ANY LAW, ORDINANCE, RULE, REGULATION OR POLICY PROHIBITING ANY PERSON FROM DISPLAYING THE FLAG OF THE STATE OF MISSISSIPPI ON THAT PERSON'S CLOTHING; AND FOR RELATED PURPOSES.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:
Amend the Mississippi Constitution of 1890, by creating a new Section 208A to read as follows:
"Section 208A. Any state agency, institution, board, commission or instrumentality, or the governing authorities of any county, municipality or school district, may not enact or enforce any law, ordinance, rule, regulation or policy prohibiting any person from displaying the official flag of the State of Mississippi on any article of that person's clothing. The Legislature shall enact such legislation as may be necessary to prohibit and prescribe penalties for violations of the provisions of this section."
BE IT FURTHER RESOLVED, That this proposed amendment shall be submitted by the Secretary of State to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 1999, as provided by Section 273 of the Constitution and by general law.
BE IT FURTHER RESOLVED, That the explanation of this proposed amendment for the ballot shall read as follows: "This proposed constitutional amendment creates a new section of the Constitution to prohibit any state agency, institution or instrumentality of the state, or the governing authorities of any county, city or school district, from enacting or enforcing any law, ordinance, regulation or policy prohibiting a person from displaying the flag of Mississippi on that person's clothing."
